Hangzhou Microimage Software Co., Ltd. and its affiliates (“HIKMICRO”, “we”, “our”, “us”) are committed to protecting the privacy, confidentiality and security of your personal information by complying with applicable laws, and we are equally committed to ensuring that all our employees and agents uphold these obligations.

This Privacy Policy explains which personal information we collect and how we use it when you use the HIKMICRO Sight App and its services (the “Services”). It also applies to any personal information we collect from the operation and use of HIKMICRO Products (the “Products”) while connected to our mobile application. By using the Services you agree to this Privacy Policy and that we, may process, transfer and store your information in the Germany.

This Privacy Policy does not apply to personal information collected by us offline or through any other means not involved in this Policy, or to personal information collected by any third party.

IF YOU DO NOT AGREE TO THIS POLICY, PLEASE DO NOT USE THE SERVICES. We reserve the right to modify this Privacy Policy at any time, so we encourage you to review it frequently. If we make a material change to this Privacy Policy, we will notify you by email or by means of a notice via push notifications within the mobile application prior to the changes taking effect, in accordance with any applicable legal obligations. Your continued use of the Services signifies your acceptance of our modified Privacy Policy. We regularly update the mobile application to make improvements, including improvements that better serve your privacy rights. To ensure that this Privacy Policy accurately reflects your use of the Services you will need to ensure that you are using the most recent release of the mobile application.

If the personal information you submitted to us contains other individuals’ data, you warrant that you have obtained the approval of such individuals.

1. What Is Personal Information?

In this Privacy Policy, Personal Information and Personal Data shall have the same meaning, which shall include any information relating to an identified or identifiable natural person (“data subject”); an identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identification number or to one or more factors specific to his physical, physiological, mental, economic, cultural or social identity. Examples of personal information include your name, telephone number, email address, physical address, and payment information.

Personal information also includes information that cannot directly identify you, but with other information we have access to can identify you, such as product serial numbers, log data that automatically records information about your visit, such as your browser type, domains, page views, the URL of the page that referred you, the URL of the page you next visit, your IP address, and page navigation, unique device ID collected from the Products and your mobile devices, data from cookies, pixel tags, and web beacons, the country and time zone of the connected Product, geo-location, mobile phone carrier identification, and device software platform and firmware information.

2. Information We Collect from You

In order to provide the Services to you, as a controller, we collect and process your personal information, and we strive to collect only the personal information that we need. If you do not provide your personal information, we may not be able to provide you with our Services. We may also collect personal information from publicly or non-publicly accessible sources, for example, Facebook, where you share the contents from the HIKMICRO Sight App. The specific types of information collected will depend upon how you use the Services, and can be divided into information that you provide to us directly and information that we collect.

Account Information. When you create an HIKMICRO account, we will collect your email address and your location, e.g. which country or district you resident. We also collect, and associate with your account, the information you provide to us when you do things such as sign up for your account, subscribe for premium services.
Contact Information. When you create an account with HIKMICRO, or contact us for customer service, you may provide us with your contact information including your name, alias, email address, shipping address, billing address and phone number(s).
Products Information. To better managing your Product and previewing the pictures or videos captured, we will collect your Product information when you connect the Products to this application, including type, verification code and serial number. We also collect the parameter and configuration information of your Product when you configure your Product in your account.
Contents Information. The Services enable you to view, save and share contents through the Services, like videos, live video streams, pictures, texts, and captions (“Your Content”). To make that possible, we may record, process and transmit the video or audio content from the Product, as well as the content you uploaded including the images, texts, sounds, when you use the Product or the Service’s features. To clarify: (i) for the streaming video you preview in real time, we only transmit it, rather than store it;(ii) When you store pictures or videos in your own SD card of your Product, you may use the Services to view the pictures or videos, in which case we only transmit your information, rather than store it; and (iii) If such content contains information about others, you should obtain any required or appropriate consent from such persons and inform them about this Policy prior to uploading such content to HIKMICRO.
Technical Information. When you visit or use the Services, you may provide us with technical information about the device running the Services. Such information includes your IP address or device address, hardware version, and operating system.
Cookies. We use cookies and other similar technologies (e.g. pixels etc.) on the Services. Cookies are used to collect information, including personal data, from you. Cookies are small files which, when placed on your device, enable us to provide certain features and functionality.

3.How We Use Your Information

HIKMICRO may use the information we collect in the following ways:

To operate and provide features of the Products and Services, to verify and manage HIKMICRO user accounts, and to provide services and information that you request. We will process your personal information in accordance with this Policy and any of your preferences, which are expressed via the Products and Services.
To communicate with you, for example, keeping you posted on our product/software updates, and changes to our terms, conditions, and policies.
To personalize your experience and customize the Services, such as delivering relevant content, recommending features through our Services, and remembering your preferences.
To improve the Services, including bug detection and error reporting, to understand how users interact with the Services, improve usability and effectiveness of the Products, perform research and analytics, and to test and create new products, features, and services.
For our business operations, including maintaining your account, and for security, fraud prevention, and legal compliance, such as detecting security incidents and protecting against malicious, deceptive, fraudulent, or illegal activity.
Other purposes for which we seek your consent. We may also use your information for a specific purpose that we communicate to you. We will ask for your consent to process your information for such purpose in accordance with applicable legal requirements.

The laws in some jurisdictions require companies to tell you about the legal grounds they rely on to process your information. Our legal bases for processing your information as described in this Privacy Policy are as follows:

Where use of your information is necessary to perform our obligations under a contract or commitment to you. For example, to provide the services you’ve requested from us, or to comply with our terms of service.
Where use of your information furthers our legitimate interests or the legitimate interests of others. For example, to provide security for the Services, operate our business and the Services, make and receive payments, defend our legal rights, and prevent fraud.
Where we use your information to comply with applicable legal obligations. For example, keeping track of purchases or subscriptions for tax and auditing purposes.
Where you have consented to our processing of your information for a particular purpose.

For the purposes discussed in this Privacy Policy, we may combine the information that we collect through the Services with information that we receive from other sources, both online and offline, and use such combined information in accordance with this Privacy Policy.

4. How We Disclose Your Information

We do not sell any personal information to third parties and we never will.

We may disclose your information in the following ways:

Affiliated entities. We may disclose information with our affiliates to deliver the Services, operate our business, and enhance the Services and your customer experience.
Service providers. We use select third-party vendors to help us provide our Services and operate our business, and we may provide access to or disclose your information to these vendors. They may provide a variety of services to us, including customer service, payment processing, marketing, product design and development, data hosting and storage, security, fraud prevention, research, and legal services. These service providers are permitted to access and use your information for purposes of performing services for HIKMICRO or to comply with applicable legal requirements.
Protection of HIKMICRO and others. We may disclose the information we collect about you if required to do so by law or in a good faith belief that such disclosure is reasonably necessary to: (a) comply with legal process (for example, a subpoena or court order); (b) enforce our terms of service, this Privacy Policy, or other contracts with you, including investigation of potential violations; (c) respond to claims that any content violates the rights of third parties; or (d) protect the rights, property, or personal safety of HIKMICRO or others.
Business transfers. As we continue to develop our business, we may buy, establish, merge, or partner with other companies. In such transactions, including in contemplation of such transactions, your information may be among the transferred assets. If a portion or all of HIKMICRO’s assets are transferred to a third party in these circumstances, we may disclose your information as part of the transaction.

5. Securing and Retention Your Information

Security of your information.

We are committed to protecting your information. We use a variety of technical, physical, and organizational security measures designed to protect against unauthorized access, alteration, disclosure, or destruction of information. However, no security measures are perfect or impenetrable. As such, we cannot guarantee the security of your information.

If you register to create a HIKMICRO account, it is important that you select a strong password and do not disclose it to others. Alert us immediately if you have any concerns about unauthorized use of your account. If you have any concerns about the security of your account, please contact us using the contact information below.

Retention of your information.

We retain information for different periods of time depending on the purposes for which we collect and use it, as described in this Privacy Policy. We will delete or de-identify information when it is no longer needed to fulfill these purposes unless a longer retention period is required to comply with applicable laws. There may be technical or other operational reasons where we are unable to fully delete or de-identify your information. Where this is the case, we will take reasonable measures to prevent further processing your information.

6. Your Rights and Choices Regarding Collected Information

You may update, correct, or delete certain HIKMICRO account information and preferences by accessing your account preferences page, available through the Services.

If you are located in the European Economic Area, you may also have the right to request access to additional information, including the right to request access to and receive certain information we maintain about you; to update or correct inaccuracies in the information we maintain about you; to receive a copy of the information which you provided for its transmission to another company; to object to the processing on grounds relating to your particular situation; and to have the information blocked, deleted, or erased, as appropriate. When we process personal data on the basis of your consent, you can also withdraw your consent. If you withdraw your consent, we will apply your preferences going forward, and this will not affect the lawfulness of the processing before you withdrew your consent.

Note, however, that if you exercise your right to object or your rights of blocking, deletion or to be “forgotten” or if you decline to share certain information with us, or if you withdraw your consent to our processing of information about you, we may not be able to provide to you some, or any, of the features and functionality of HIKMICRO Products and Services.

Likewise, if you close your HIKMICRO account, you will not be able to sign in to the Products or Services or access any of your information. However, you can open a new account at any time. Please note that while any changes you make will be reflected in active user databases within a reasonable period of time, we may retain all information you submit, as authorized under applicable law, for backups, archiving, prevention of fraud and abuse, analytics, satisfaction of legal obligations, or where we otherwise reasonably believe that we have a legitimate reason to do so. In addition, if certain information has already been provided to third parties as described in this Policy, retention of that information will be subject to those third parties’ policies.

Marketing choices.

You may not receive any marketing or advertising emails from us; however, you may receive transactional communications from us regarding your account or important legal information.

7. Children's Privacy

Our Services are intended for general audiences and are not directed at children. If we become aware that we have collected data without legally valid parental consent from children under an age where such consent is required, we will take reasonable steps to delete it as soon as possible.

8. Global Operation and Data Transfers

In general.

We operate globally and may transfer, store, and/or process your information to or with our affiliates or other third parties such as trusted service providers and partners in locations around the world (including Germany, Singapore and China) for the purposes described in this Privacy Policy. Wherever your information is transferred, stored or processed by us, we take reasonable steps to protect your information in accordance with this Privacy Policy and applicable laws. These measures may include implementing Standard Contractual Clauses to govern the transfer of your information, or other means recognized by applicable laws. By providing us with your information, you acknowledge any such transfer, storage, or processing.

If you have any concerns or complaints about our data processing activities, we urge you to first try to resolve such issues directly with us. However, if applicable, you may make a complaint to the data protection supervisory authority in the country where you are based, or seek a remedy through local courts if you believe your rights have been breached.

HIKMICRO commits to resolve complaints about your privacy and our collection or use of your Personal Data (without charge to you). If you have an unresolved privacy or data use complaints that we have not addressed satisfactorily, please contact us at support@hikmicrotech.com or in writing to: Room 313, Building B, No. 399, Danfeng Road, Xixing Street, Binjiang District, Hangzhou, Zhejiang, China. We will respond to any complaints as soon as possible and within 45 days.

9. Changes to our Privacy Policy

From time to time we may change or update this Privacy Policy to reflect changes in the law, our data collection and use practices, the features of our Services, or advances in technology. You should review the Privacy Policy periodically, and you can know if the Privacy Policy has changed since the last time you reviewed it by checking the “Effective Date” at the beginning of the document. By continuing to use the Services, you are confirming that you have read and understood the latest version of this Privacy Policy. If we make material changes to the Policy, we will provide notice through your emails or the Services, or by other means, to provide you the opportunity to review the changes before they become effective, in accordance with applicable legal requirements.

We also use cookies and other technologies when you use the Services. This allows us to better understand how you use our Services, diagnose and troubleshoot any problems you’re having, and otherwise administer and improve our Services.

If you are a California resident, the California Consumer Privacy Act (“CCPA”) requires us to provide you with the following additional information about:

the purpose for which we use each category of “personal information” (as defined in the CCPA) we collect; and
the categories of third parties to which we (a) disclose such personal information for a business purpose, (b) “share” personal information for “cross-context behavioral advertising,” and/or (c) “sell” such personal information.

Under the CCPA, “sharing” is defined as the targeting of advertising to a consumer based on that consumer’s personal information obtained from the consumer’s activity across distinct online services, and “selling” is defined as the disclosure of personal information to third parties in exchange for monetary or other valuable consideration. We will not “share” information of you with any third-party regarding the Services.

Such information may be used for the purposes for which it was collected or as otherwise permitted or required by applicable law.

We have not sold in the preceding twelve months from the date of last review of this Privacy Policy, do not currently sell, and will not sell your personal information for twelve months from the date of the last review of this Privacy Policy.

As of the date of last update and review of this California Privacy Notice, we have no reason to believe that we have collected, disclosed, sold or otherwise processed the Personal Information of more than 4 million California Consumers.

Personal Information rights.

If you are a Consumer, California law may permit you to request information regarding the:

Categories of Personal Information (as defined by applicable California law) collected, sold or disclosed by us;
Purposes for which categories of Personal Information collected by us are used;
Sources of information from which we collect Personal Information; and
Specific pieces of Personal Information we have collected about you.
In addition, if you are a Consumer you may:
Opt-out of the sale or disclosure of your Personal Information, in some circumstances;
Opt-out of receiving marketing communications from us; however, you may still receive administrative communications regarding the Services;
Opt-in to certain financial incentive programs we may offer related to the collection, sale, or deletion of your Personal Information; and
Request deletion of your Personal Information by us and our service providers, in some circumstances.

Further, California law provides Consumers with the right not to receive discriminatory treatment by a business for the exercise of these rights regarding Personal Information.

You can make requests related to your California privacy rights at the attached link . You may also make those requests by email to support@hikmicrotech.com. Please be aware that we do not accept or process requests through other means (e.g., via fax or social media).

We will review the information provided and may request additional information to ensure we are interacting with the correct individual. If you have an online account with us, you may be required to log-in to your account for identity verification. If you do not have an account with us, additional information to verify your identity may be required by law before we may take action upon such a request. This additional information may vary depending on the nature of your request and/or the nature of the information about which your request relates. In some cases, we may also be required by law to obtain a signed declaration under penalty of perjury from you that you are the subject of the request being made. If we suspect fraudulent or malicious activity on or from your account, we will delay taking action on your request until we can appropriately verify your identity and the request as authentic.

By law, we are not required to collect personal information that we otherwise would not collect in the ordinary course of our business, retain personal information for longer than we would otherwise retain such information in the ordinary course of our business, or re-identify or otherwise link information that is not maintained in a manner that would be considered personal information. If we have not requested specific additional information from you to verify your request, please do not send such information.

We generally will aim to avoid requesting additional information from you for the purposes of verification. However, if we cannot reasonably verify your identity or more information is needed for security or fraud-prevention purposes, we may consider any of the following factors, alone or in combination, in requesting additional information:

The type, sensitivity, and value of the personal information collected and maintained about the consumer, as applicable law requires a more stringent verification process for sensitive or valuable personal information;
The risk of harm to the consumer posed by any unauthorized access or deletion;
The likelihood that fraudulent or malicious actors would seek the personal information;
Whether the personal information to be provided by the consumer to verify their identity is sufficiently robust to protect against fraudulent requests or being spoofed or fabricated;
The manner in which the business interacts with the consumer;
Available technology for verification; and
Other factors that may be reasonable in the circumstances, are consistent with industry practice, are recommended by California government officials, or which may be required by law or regulation following the effective date of this Privacy Policy.
If your request is regarding household information, the same verification steps above are required before we can provide you with aggregate household information. For us to process a request for access to or deletion of specific pieces of information regarding your household, all members of the household must make the request, and we must be able to verify each household member.

In some cases, we may not have sufficient information about you or your household to be able to verify your identity or sufficiently differentiate you from another consumer or household to the degree of certainty required by law, in which case, we will not be able to act upon your request. In such cases, it may be unlikely that we would be able to identify you or your household in the future without collecting significantly more information or seeking to re-identify de-identified information. At this time, we do not intend to take such steps in response to a request made pursuant to this Privacy Policy and applicable law does not require that we do so. If, in the future, we determine a reasonable method to identify you or your household absent such steps, we will provide an update to you through this Privacy Policy and in response to any such request at that time.

Information that you submit for the purpose of allowing us to verify your identity in furtherance of a consumer-related or household-related request pursuant to California law will only be used by us, and our service providers if any, for that purpose and no other. Except where we are required by law to maintain such information for record-keeping purposes, we will take steps to delete any new personal information collected for the purpose of verification as soon as practical after processing your request.

Please also be aware that making any such request does not ensure complete or comprehensive removal or deletion of Personal Information or content you may have posted, and there may be circumstances in which the law does not require or allow us to fulfill your request, including, for example, where fulfilling your request may infringe upon the rights and freedoms of other consumers.

We reserve the right to charge a reasonable fee or take other appropriate action in response to requests from a consumer or household that are manifestly unfounded or excessive, in particular because of their repetitive character.

You may designate an authorized agent to make a request on your behalf pursuant to applicable law. We accept documentation of your designation in the form of a valid power of attorney and/or a notarized statement. You must submit evidence of your designation of an authorized agent in writing to: Room 313, Building B, No. 399, Danfeng Road, Xixing Street, Binjiang District, Hangzhou, Zhejiang, China. We may require verification of your authorized agent in addition to the information for verification above for consumers and households.

Do Not Track.

HIKMICRO does not currently take steps to respond to browsers’ “Do Not Track” signals as no uniform standard to respond to such signals has been developed at this time.

Financial incentives.

HIKMICRO does not offer any financial incentives in exchange for your personal information at this time.

Right to Limit.

The CCPA allows you to limit the use or disclosure of your “sensitive personal information” (as defined in the CCPA) if your sensitive personal information is used for certain purposes. Please note that we do not use or disclose sensitive personal information other than for business purposes for which you cannot opt out under the CCPA.
