HIKMICRO LIMITED WARRANTY

1. Introduction

1.1 NOTE: This warranty policy only applies to HIKMICRO branded products (“HIKMICRO Products”), and the warranty service will be provided by HANGZHOU MICROIMAGE INTELLIGENT TECHNOLOGY CO., LTD. ("HIKMICRO" or “we”) and HIKMICRO’s affiliates. This warranty is voluntarily offered by HIKMICRO and is separate and in addition to the legal rights of consumers under applicable laws of your location governing the sale of consumer goods and to any rights of the consumer against the original retail seller of the Product and, therefore, does not affect, change or replace such rights. Should your product be defective or does not conform to the contract of sale, you can claim under applicable consumer law of your location against your seller, or against us according to this HIKMICRO Warranty Policy (whichever is applicable). 
This document only applies to consumer products. For professional products, the warranty terms of the sale or purchase agreement shall apply.

1.2 Amending this Policy: HIKMICRO reserves the right to amend this Policy, in part or its entirety, at any time, without notice. 

1.3 Limited Warranty: We warrant HIKMICRO Products against defects in materials and workmanship when used normally in accordance with its specifications published at the time of purchase, including but not limited to information contained in technical specifications, user manuals, and the HIKMICRO website. This limited warranty extends only to you and is not transferable to any other party and any transfer made in violation of this provision shall be void. 
We will determine the warranty of the HIKMICRO Products based on the location it is originally sold, if your current location is inconsistent with the original selling location, the original selling location shall prevail. For any defective HIKMICRO Products under warranty, HIKMICRO will, at its option, (i) repair or replace your product free of charge; or (ii) exchange your product with a functional equivalent product. At HIKMICRO’s sole discretion, repair or replacement may be made with a new or refurbished product or components. This warranty does not cover the shipping cost, insurance, or any other incidental charges incurred by you in returning the product. 

1.4 Warranty Period: Your HIKMICRO Products'warranty period shall be as the following, or such longer period as may be required by applicable law in the country where the product is sold:

The warranty period will start from the date of purchase for HIKMICRO Products, or from the date your products registered to your HIKMICRO Account subject to conditions stated in HIKMICRO's mobile applications (e.g. HIKMICRO Sight App) or HIKMICRO website. Please NOTE THAT the warranty period provided by HIKMICRO may vary depending on the country or state where this product is sold. 

Except where prohibited by applicable law, this is your sole and exclusive remedy for breach of this warranty. Any product that has either been repaired or replaced under this warranty will be in the original.

1.5 Warranty Proof: Before receiving warranty service, you should furnish proof of purchase details, including the following docusments: 

a. Invoices, including the paper invoices, E-invoice, or invoice copy of the original retail purchase of the Product can be used to verify the warranty status;

b. Warranty Request Form; and

c. Original receipt for the original retail purchase of the Product that can clearly indicate the Product name, price and date of purchase.

If this information is not provided, is incomplete, or is intentionally obscured, the warranty period will start from the shipment date from the factory, or HIKMICRO reserves the right to refuse the warranty service.

1.6 Extended Warranty: For the following products, HIKMICRO will provide an extra 180-day warranty in case consumers have registered the products in his/her HIKMICRO Account within 30 days from the purchasing date. To verify the accurate purchase date, consumers may be required to submit the original invoices.

2. General Return Requirements

2.1 Return Requirements: To obtain warranty service from HIKMICRO within the warranty period, please contact rma@hikmicrotech.com, or via online service at HIKMICRO website. 

2.1.1 RMA Number Required: Approval from HIKMICRO, you should send the warranty request for return authorization (as the form in Appendix 1) to get a Warranty Request Form with RMA Number issued by HIKMICRO before you return your products. HIKMICRO may refuse to provide warranty services if the Request is not sent in advance, and the defective product will be returned to you with freight due.

2.1.2 RMA Discrepancies: HIKMICRO reserves the right to return the product to you at your expense, if upon receipt of the product, HIKMICRO determines that the prerequisites for the returning have not been met and/or that the product returned does not match the product described in the request form. HIKMICRO further reserves the right to charge you handling fees for such returns.

2.1.3 Expiration: An RMA number is valid for fourteen (14) calendar days after its issuance by HIKMICRO. You must return the product described in the RMA within fourteen (14) days or a new RMA will be required.

2.1.4 Packaging Requirements: When packaging the products for shipping, all returns must meet the following requirements:

a. All returned products must be packaged appropriately to prevent shipping damage with individual mechanical protection and proper electrostatic discharge (ESD) protection.

b. The packing of the returned products shall be the same or equivalent to the original packing you purchased.

c. If you have more than one warranty request, you should return the products separately with the respective RMA number marked accordingly. 

d. Each package of your returned products must be clearly labeled with the RMA number and your address. If you are returning products in several boxes with the same RMA number, please mark each box as the serial number to avoid partial shipments (for example, if you return three boxes, the boxes shall be marked as part 1 of 3, part 2 of 3, and part 3 of 3).

e. Please return your products with a copy of the request form.

f. Please do not return your products with your purchased accessories. HIKMICRO is not liable for any damage or loss of Accessories during repair or replacement.

2.2 Turnaround times: You acknowledge that turnaround times are dependent on that of the applicable manufacturer, your compliance with this RMA policy and other variables. HIKMICRO does not warrant that turnaround times will comply with any specific timeframe or with your requirements.

   3. Warranty Scope

3.1 Scope: This policy does not cover the following, except that you require a chargeable maintenance service.

3.1.1 The warranty proof cannot be provided, the former serial number label is altered, changed or torn down, or the product information listed in the proof is inconsistent with the product.

3.1.2 The warranty period is exceeded.

3.1.3 Malfunctions and damages resulting from failure of use, maintenance and storage according to the user manual or the working environment indicated in the user manual.

3.1.4 Malfunctions or damages resulting from installation, repairs, changes or disassembly by the organizations NOT authorized by HIKMICRO.

3.1.5 Damages resulting from electrical short circuit, transients, accident, fire, flood or other force majeure.

3.1.6 Product subject to force majeure-related damage (fire, earthquake, flood, etc.). Cosmetic damage, including but not limited to scratches, dents, and broken plastic on ports.

3.1.7 Any software, even if packaged or sold with HIKMICRO hardware products.

3.1.8 For any other damages free from defects in material or workmanship.

3.1.7 Unauthorized sources of supply.

3.2 Limitation of Liability

3.2.1 EXCEPT FOR THE EXPRESS WARRANTIES SET FORTH ABOVE, HIKMICRO GRANTS NO OTHER WARRANTIES, EXPRESS OR IMPLIED, BY STATUTE OR OTHERWISE, REGARDING THE HIKMICRO PRODUCT, FITNESS FOR ANY PURPOSE OR OTHERWISE. CONSUMER LAW IN SOME COUNTRIES DOES NOT PERMIT LIMITATIONS UNDER A PRODUCT WARRANTY AND THEREFORE CERTAIN LIMITATIONS SET OUT IN THIS WARRANTY DOCUMENT MAY NOT APPLY TO YOU.

3.2.2 HIKMICRO IS NOT RESPONSIBLE OR LIABLE FOR THE DAMAGE TO OR LOSS OF ANY PROGRAMS, DATA, SD CARD OR REMOVABLE STORAGE MEDIA WHERE YOU DO NOT BACKUP YOUR DATA BEFORE DELIVERING YOUR PRODUCT TO HIKMICRO FOR SERVICE UNDER THIS WARRANTY.

3.2.3 TO THE EXTENT PERMITTED BY LOCAL LAWS, HIKMICRO SHALL NOT BE LIABLE FOR ANY LOSS WHICH IS NOT A REASONABLY FORESEEABLE CONSEQUENCE OF A BREACH BY HIKMICRO OF THIS WARRANTY. AS A CONSUMER YOUR USE OF THE DEVICES SHALL BE NON-COMMERCIAL. HIKMICRO SHALL THEREFORE NOT BE LIABLE TO YOU FOR ANY LOSS OF PROFITS, REVENUE, ANTICIPATED SAVINGS CONTRACTS OR TIME ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE DEVICE.

3.2.4 IN ANY EVENT, HIKMICRO’S LIABILITY UNDER THIS LIMITED WARRANTY SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY THE CONSUMER FOR THE PRODUCT OR THE CURRENT REPLACEMENT VALUE, WHICHEVER IS GREATER.

3.2.5 NOTHING IN THIS WARRANTY SHALL EXCLUDE OR LIMIT HIKMICRO’S LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY ITS NEGLIGENCE, FRAUD, FRAUDULENT MISREPRESENTATION OR ANY OTHER LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED BY LAW.

4. In-Warranty Service

4.1 Returns whether In-Warranty or Out-of-Warranty: You are responsible for determining which of the defective products are within the product warranty period or otherwise and, if they fall outside, you shall be responsible for all expenses and costs incurred thereby (including the cost of repair or replacement of such defective products).

4.2 In-Warranty Service: In-Warranty Service is applicable for defective products within the product warranty period under the relevant contract terms. Please check and confirm the respective product warranty period provided under the relevant contract terms.

4.3 Eligibility: You are eligible for In-Warranty Returns so long as the terms and conditions of the product warranty have been met and the product is still within the warranty period. 

4.4 Repairs: Please complete the warranty request form indicating as much information to assist the repair department with diagnosing and repairing the item. Once the item is received the appropriate repair technician determines warranty status by checking the serial number and/or firmware version with original shipping documentation (please reference warranty for products on the sheets under clause1.5) Warranty goods are repaired without contacting you. If a Non warranty item requires repair you are sent an “Estimation of Charges” form which they can review and sign if acceptable. Non warranty items require written authorization from you. If an item is deemed "un-repairable" you are contacted and have the option of (1) having the product returned or (2) having the product scrapped. In addition, some of the documents such as pictures, videos or others saved in your device may be deleted after repair process whereof the mainboard replacement etc. You agree that it is your responsibility to delete all personal files and data you created on the returned device before returning it. If you wish to retain any files or data, please make your own backups prior to returning the device. We are not responsible to remain on or are erased any files or data from the returned device.

4.5 Request Period: The warranty request must be made within the warranty period, which determines whether the products are in-warranty or not.

4.6 Freight Charges: The freight cost for your shipment to HIKMICRO will be at your expense, and HIKMICRO will afford the freight cost for shipping the product to you.

5. Out-of-Warranty Service

5.1 Out-of-Warranty Service: Out-of-Warranty Service is applicable for defective product that are not covered within the warranty scope.

5.2 Eligibility: Out-of-Warranty Service are by approval and upon payment of HIKMICRO’s prevailing administrative fee. 

5.3 Request Period: The RMA request can be made at any time, but HIKMICRO is under no obligation to provide support or repair for Out-of-Warranty Returns.

5.4 Freight Charges: The freight cost shall be all at your expense.

6. Export Control

You may not use or otherwise export or re-export the products serviced except as authorized by the laws of the jurisdiction in which the products were obtained. In particular, you shall comply with all the applicable import and export regulations including without limitation, REGULATION (EU) 2021/821, the Chinese Export Law, the U.S. Export Administration Regulations and other applicable laws and regulations related to export control and economic sanctions in different jurisdiction. You represent that you are not located in any country or on any list where the provision of product to you would violate applicable law. You also agree that you will not use products for any purposes prohibited by applicable law.

Appendix 1

Request for Return Authorization

Please complete all fields to processing. HANGZHOU MICROIMAGE INTELLIGENT TECHNOLOGY CO., LTD. will issue RMA# within 24 hours after receipt of completed form. Package without RMA# on the box will not be accepted. All returned products are subject to verification by HANGZHOU MICROIMAGE INTELLIGENT TECHNOLOGY CO., LTD. RMA progress will normally take 2 to 4 weeks depends on the stock of the product and component.
